PLEASE READ CAREFULLY THE FOLLOWING TERMS BEFORE ENTERING IN ANY OF OUR GIVEAWAYS. By clicking the icon stated in each giveaway announcement you acknowledge to have read, understood and consent to be bound by the below terms and conditions.

1 Definitions

1.1 «affiliate»: VOICEMOD’S partners or its employees, subsidiaries’ employees, advertising and promotion agencies collaborating in the giveaway, suppliers and its employees, as wells as any immediate family members and/or those living in the same household of each. It shall be deemed as an affiliate as wells any relative to a VOICEMOD team member or employee

1.2. «employee»: any team member of VOICEMOD.

1.3 «user»: natural person that enters or take part in the giveaway.

1.4 «VOICEMOD»: as stated above, VOICEMOD is a Spanish legal entity responsible for the giveaway, with headquarters in Valencia, calle Obispo Don Jerónimo, 10 Bajo (46003) with Tax Id. number B98657844, registered in the Valencia Mercantile Register in volume 9835, book 7117, sheet 74, page V-160921, entry no. 1ª.

2. Giveaways description

2.1 Entries will be accepted starting on Tuesdays, 00:01am GMT+1 and ending Tuesdays, 11:59pm GMT+1, both inclusive.

2.2 All entries received after Tuesdays 11.59pm GMT+1 will not be accepted.

2.3 The giveaways will be valid throughout the territory of the world.

3. Nature of the giveaway

3.1The following giveaway is free and no entry or participation restrictions shall be applicable other than those set out below.

3.2 This giveaway has not been promoted or sponsored by any other entity other than VOICEMOD.

3.3 Eligibility: all members of VOICEMOD’s Discord public server are eligible to participate in this giveaway provided they sign up by clicking the icon indicated on the post. Additionally, participants shall meet the following requirements:
3.3.1 to be a natural person
3.3.2 to be 14 years old or over.

3.4 If on the contrary, the member is below the indicated threshold, VOICEMOD will need parental consent when communicating the prize to the winner.

3.5 The «user» must meet all requirements, as specified, to be eligible to win the prize.

3.6 VOICEMOD as promoter of the giveaway may at its own discretion disqualify, ban, or decide whether a user may or may not continue to participate in the giveaway where such does not meet the provided criteria.

3.7 Participation is not permitted to employees or any other affiliate of VOICEMOD, S.L. Consequently, such are not eligible to participate in the giveaways.

1. SIGN UP

1.1 The procedure to enter into the giveaway, where the above criteria is met, is the following:
1.1.1 VOICEMOD will post every Tuesday a giveaway announcement.
1.1.2 The users will be able to participate by clicking the icon indicated in said announcement.
1.1.3 Our giveaway bot will collect all entries and select among these the winner(s) of the giveaway as soon as the giveaway is closed.
1.1.4 VOICEMOD will get in contact with the winners via Discord’s DM to finalize the details.

2. Winner selection, notification and prize delivery

2.1 The odds of winning the prize depends on the number of eligible entries received.
2.1.1 The winner be selected among all the entries received by the means therebefore randomly. VOICEMOD uses a bot in order to collect entries and select the winner.
2.1.2 No purchase necessary: any purchase will increase participants’ odds of being selected as winner.

2.2 Winner(s) will be notified via DM to his or her Discord profile within 24 hours following the selection, and further details will be given by VOICEMOD to the winner via email.

2.3 Nor VOICEMOD, nor any of the sponsors or promoters of the giveaway, are not responsible for, nor shall have no liability for winner’s failure to receive notices due to email or Discord’s profile security settings that may cause notifications to be marked as spam or junk; nor for the winner’s provision of incorrect or otherwise non-functioning contact information.

2.4VOICEMOD will make reasonable efforts to contact the winner. If the winner(s) cannot be contacted or is not available within 2 days from the winner(s) selection date, VOICEMOD reserves the right to offer the prize to the next eligible user selected in the same manner.

The above considerations and provisions shall apply where the winner(s) rejects the Prize.

2.5 VOICEMOD will contact winner in order to send him or her the instructions to enjoy the price via email.

2.6 The winner(s) will not be able to request a change in the Prize or financial compensation for the value of the Prize. In other words, they may only waive the Prize but in no case will an alternative prize be offered, nor will such waiver give right to compensation or indemnification.

3 Modification and/or cancellation of the giveaway

3.1 VOICEMOD reserves the right, in its sole discretion, to modify and/or cancel the giveaway at any time. These circumstances will be duly announced by VOICEMOD through the means used for the celebration of the giveaway.
3.2 VOICEMOD may also make the changes it deems necessary and appropriate for a better development of the giveaways, in which case VOICEMOD will also communicate such changes through the above-mentioned means.
3.3 In the event of cancellation of the giveaways, [provided that the period established in these Terms and Conditions has not expired], VOICEMOD does not undertake to award the prize expressly indicated.

4 Tax obligations

4.1 To the prizes of the present giveaway all the pertinent regulations of fiscal nature according to the Spanish legislation in force will be applicable to them.
4.2 In any case, the user will be solely responsible for the compliance of the tax obligations in his/her respective country.

5 Data protection: informed consent

5.1 The personal data that may be provided by the users as part of their entry in the giveaway will be processed in accordance with the provisions of this clause on data protection, having more information in the Privacy Policy of VOICEMOD. In this regard, users give their free, specific, express and unequivocal consent for their data to be processed for the purposes set out in the following clause.

5.2 By participating in the present giveaway, user consents to the processing of his/her personal data for the purposes outlined below:
5.2.1Managing participation in the giveaway;
5.2.2 To certify compliance with eligibility requirements
5.2.3 In the event of being a winner, communication and management of the prize delivery

5.3 The personal data will be kept for the time necessary to carry out the aforementioned purposes, unless the participant requests to be removed from the giveaway or revokes his/her consent.

5.4 The basis of legitimacy of such processing will be the consent of the data subject. Consent is deemed provided by clicking the icon appointed at the giveaway announcement. Such consent may be withdrawn at any time. In the event that it is withdrawn, this will not affect the lawfulness of the processing carried out previously. It is to be noted that withdrawn of the consent before the closing of a giveaway will imply termination of the participation of the user in such giveaway.

5.5 The personal data to be processed are: e-mail address and Discord username.

5.6 By accepting these Terms and Conditions, the user consents the communication of his/her personal data, in particular his/her name and surname, the username, or any social media profile.

5.7 The user, as a data subject of the aforesaid processing, shall have all the rights that the current Personal Data Protection regulations confer to data subjects: right of access; to rectification; erasure and to be forgotten; restriction of the processing; data portability; to object; opposition to processing for direct marketing purposes and the right not to be subject to automated individual decisions.

5.8 For all matters relating to data protection not covered by this clause, the provisions of the Privacy Policy of VOICEMOD, S.L., shall apply.

6 Authorisation to use the winner’s Discord username and assignment of image rights

6.1 The winner(s) authorise(s) VOICEMOD, S.L. to reproduce and use his/her/their Discord username(s) and profile picture in any advertising or promotional activity in whatever means or media (Internet, social media or others) related to this giveaway, without any geographical limitation whatsoever and for an unlimited period of time or shall be the case for as long as VOICEMOD may need, from the date of acceptance of the Prize, without this conferring any right to remuneration or benefit of any nature, except for the Prize received.

7 Applicable law and courts

7.1 This giveaway is governed by the laws of Spain and all entrants consent to the exclusive jurisdiction and venue of the courts of Valencia for any disputes arising out of this giveaway.
Any action, suit or case arising out of, or in connection with, this Giveaways or these Giveaways Terms and Conditions must be brought in courts located in Valencia.
COMMUNICATION

7.2 Any communication that needs to be addressed to the user will be made at the address provided by the user or through the application or service itself, depending on the version purchased, and will be fully effective until the user communicates any other address for this purpose. These communications may refer to matters of importance and interest to you, such as modifications, updates, offers, promotions or incidents, so you should consult them regularly.

APPLICABLE LEGISLATION

The relationship between us and you as a user of our applications and services will be governed and interpreted, regardless of the conflicts that may arise, in accordance with the provisions of these terms of use and, insofar as they are not provided for, by Spanish law.

RESOLUTION OF CONFLICTS: JURISDICTION

If you have any problem with any of our applications or services, please contact us and we will do our best to solve it. Any conflict that may arise between us and you in relation to these terms of use will be tried to resolve it in good faith and in an amicable manner, before going to court to resolve it, as provided in these terms of use. However, if we cannot resolve it amicably, for the resolution of any conflict or dispute that may arise in the interpretation, application and enforcement of these terms and conditions or use of our applications and services, to the extent that the law of your country of residence does not prohibit it, both you and we will submit exclusively to the jurisdiction of the Courts of the city of Valencia (Spain), expressly waiving the jurisdiction and competence that by law may correspond.
